Medico-legal Work

We provide an Expert Witness service in clinical negligence and personal injury litigation. We have undergone training in the legal process, including in relation to the Woolf Reforms & Civil Procedures Rules.

We conduct and prepare Occupational Therapy, Rehabilitation, and Care assessments and reports for clients, taking into consideration the individualís pre-injury function and activity, and provide appropriate recommendations for rehabilitation, equipment, adaptations, and past and future care.

We also have experience in Criminal Injury cases, Family Law cases, and in cases involving local authorities in relation to the provision of housing, equipment, and adaptations.

Instructions are received equally from solicitors and insurance companies on behalf of Defendants, and Claimants. We also carry out single joint instruction work.

We can take on cases at short notice, and aim to have an assessment carried out and report completed within 2 to 4 weeks of instruction, dependent upon the complexity of the case, and the needs of the person instructing us.

Immediate Needs Assessments

An Immediate Needs Assessment (INA) is conducted for an individual in order to determine their needs to assist them to return to their optimum level of function and independence in their daily life, including work, and leisure activities, following an accident, for example. This includes -

  • Physical needs
  • Cognitive needs
  • Emotional and psychological needs
  • Social needs

The completed report identifies recommendations for rehabilitation, goals (short term and longer term), and a plan is drawn up for implementation in the first month.

INA reports timescales

  • The individual will be contacted within 24 hours of receipt of referral
  • The appointment will be made to undertake the INA within 5-7 days
  • The INA Report will be sent to the referrer/s within 14 days from assessment

If there is a delay in sending out the completed report due, for example, to the need to obtain supporting medical information, this will be discussed with the referring party / parties.

As agreed, a report can be provided with an addendum report to be completed once medical information has been received. This avoids any delay in commencing rehabilitation or the provision of equipment.

Case Management

Following completion of the INA, case management is carried out, on instruction of the referring parties.

As required and agreed, therapeutic services can be arranged, including - physiotherapy, and cognitive behavioural therapy, and discussion can start to take place with employers, as appropriate

A short update report is sent to the referring parties at the end of the month and a revised implementation time is included for the following month.

  • Referring parties will be contacted during the client's rehabilitation if further authorisation is required or to provide important updates.
  • A monthly update is provided to referring parties, regarding the progress of the individual, including their treatment. This includes information such as when the individual's condition has plateaued in their rehabilitation or they have fully recovered and require no further interventions.
